GURUGRAM: The developer of Chintels Paradiso, whose four buildings have been deemed unfit for habitation since a tower collapsed in February 2022, announced on Tuesday that it is rescinding its offer to rebuild or renovate the affected homeowners’ apartments because nobody has opted to do so to date.

According to Chintels India, the original offer, which paid the homeowners of towers D, E, and F Rs 6,500/sqft in compensation and refunded the stamp tax and the cost of interior remodeling, is still valid. About 80 prospective purchasers have reportedly already selected Option 1 according to the developer.

The three towers have 180 apartments.

“Since no unit owner has yet accepted the terms and conditions, we have withdrawn the second choice. However, the developer said in a letter to the society’s RWA and the district government, “The first choice is still open.

“About 52 agreements have been signed by the 80 to 85 families that choose option 1. 10% of the check’s total value was distributed to these 52 apartment owners, according to the letter.

After a sixth-floor apartment in Tower D collapsed on February 10 of last year, killing two women, the Sector 109 society came under fire. Towers D, E, and F were deemed unsafe for habitation in structural audits conducted in the wake of the disaster; tower G was later added to that list.

The second alternative, to rebuild or refurbish the structures, was deemed “not viable” by the society’s RWA president Rakesh Hooda. There would have been no deadline for taking ownership of their flats, and flat owners would have had to pay Rs 1,000 per square foot.

In order to provide monthly rentals to displaced flat owners, waive off the money, and set a definite date for possession, the district administration and the developer should design a new option 2, Hooda stated.

There were no buyers for option 2 because of uncertainty around approvals, timeframes, and the developer’s future, according to a spokesman. We would be pleased to speak with more flat owners who are considering using option 1.

First come, first served will govern the complete and final payments. Chintels India pledges its future full collaboration with the RWA and Paradiso inhabitants and expresses the hope that we can cooperate to find a swift settlement, according to the letter.

MUMBAI: The state consumer commission ordered a housing society in Deonar to pay Rs 55,000 as reimbursement and perform repairs and water-proofing of two-row houses after observing that a housing society cannot shirk its responsibility for necessary maintenance just because the owners have given the house on rent.

The Maharashtra State Consumer Disputes Redressal Commission stated, “It is hereby declared that the opponent (society) has committed deficiency in service as well as an unfair trade practice.”

Additionally, it disproved the society’s assertion that the leak continued because the renters were watering the plants on the terrace. It was the responsibility of the society to make repairs and ensure adequate maintenance of the row dwellings held by the complainants, it stated, “Admittedly, complainants were members of the society.”

In 2017, Madhuban Cooperative Housing Society Ltd was the target of a complaint filed by Latika and Prakash Chanderkar of Worli. The district commission, however, dismissed their grievance in 2018. The state commission was then shifted as a result.

The complainants stated that they had bought two-row homes and were paying monthly service fees, including repair and maintenance fees, on a regular basis.

According to them, a significant leak was discovered in the ceiling above the bathroom, kitchen, toilet, and slabs of the first and first floors in March 2017. They gave notice to the housing society, which had waterproofed every other colony unit.

The complainants claimed that society failed to remedy their homes’ leaks and waterproofing. They claimed to have notified the society on March 2, 2017, but they never heard back. Although reminders were sent, nothing was done.

They claimed that failing to perform repairs while collecting maintenance fees amounted to both a defect in service and unfair business practices.

The housing society disputes the claim that it didn’t perform any repairs. Instead, it said that because there had been several complaints from members regarding the leak, a structural audit had been completed in December 2014, and repairs were in the works.

PUNE: Members of the State Housing Federation have developed a mobile application with the assistance of the department of cooperation to instruct housing societies on how to execute a conveyance deed or considered conveyance.

The conveyance deed, also known as a presumed conveyance, refers to the builder transferring land in the name of the housing society. According to state officials, more than 60,000 of the 1.15 lakh registered cooperative housing societies in Maharashtra still need a conveyance document or presumed conveyance. The members claimed that it is free to download the “Housing Co-op Master” app from the Google Play Store.

According to Shree Prasad Parab, member and knowledgeable director of the Maharashtra State Cooperative Housing Federation, the app also has data on society statutes. More societies will be able to complete the process and contact the department with questions if they are aware of conveyance or considered conveyance, according to Parab.

A free seminar series on transferring land in the name of housing societies has also been launched by the federation. In addition to deputy registrars, we received support for the app from senior secretary of the state cooperation department Anoop Kumar and commissioner Anil Kawade, according to Parab.

Videos that have been posted to the app cover a variety of subjects, including considered conveyance, its procedure, and mutation entries. The software would be useful to societies, according to a senior official in the cooperation department, because few people were aware of the transfer deed’s process and significance.

MUMBAI: We expect that none of the highrise developments in the city should render people susceptible and prone to such mishaps, in which innocent people might get maimed or lose their life, stated HC in directing BMC to develop standards for the use of cranes in highrise structures.

In a plea, Lokhandwala Residency Tower Cooperative Housing Society of Worli “brings to the fore fundamental issues in regard to safety precautions to be implemented in the construction of super highrise buildings,” according to the High Court.

According to the petition’s senior attorney Prateek Seksaria, the deaths of two people as a result of the building being done on the next property for “Four Seasons Private Residences Phase | and II” by a developer, served as the catalyst for the petition. The public was concerned that crane construction could harm other lives.

The HC noted that the incident on February 14, 2023, was “to put it mildly, too tragic.” “We fully feel that the freedom of a person to roam about in locations that are not actually building sites, if threatened by a fear of being killed or injured, would undoubtedly amount to a breach of one’s fundamental right to life,” the bench declared in ruling on the petition.

Sakseria claimed that the petitioner’s goal is to maintain safety while preventing obstruction of current development. Zal Andhyarijuna, the developer’s senior attorney, claimed it was an accident and that his client was deeply saddened by it.

He claimed that in order to accomplish the balance job, the developer tried to apply tight safety standards. For such crane operations, the civic body requires and is willing to prescribe safety measures, according to senior lawyer N V Walawalkar representing the BMC.

Highrises that are still under construction frequently have suspended cranes, according to HC, who also expressed confidence that the municipal commissioner will look into these matters and implement the necessary rules.

AHMEDABAD: On Monday, a division bench of the Gujarat high court upheld a single judge’s decision to allow the redevelopment of a housing society in the Vejalpur neighborhood because more than 75% of the flat owners had agreed to it and the Ahmedabad Municipal Corporation (AMC) had also granted permission for new construction.

In the case involving the Swami Vivekanandnagar Cooperative Housing Society, 74 (93%) of the 78 unit owners gave their assent to reconstruction because the structures, which were built in 1969, were in a deteriorated state.

By determining that the requirements for redevelopment under section 41A of the Gujarat Ownership Flats Act were met, the sole judge on June 21, 2022, opened the way for the reconstruction of the society. The lone judge overruled the concerns put forward by the minority of dissenting members.

The society’s members made the decision to pursue renovation in 2019 and entered into an agreement with Excel Life Space LLP. The problem reached the HC after the statute was revised to make it clear that 75% of members must agree to redevelopment because of objections from four members.

The HC instructed the AMC to make a decision regarding the society’s request for redevelopment. If the current structure is demolished and new ones are constructed on the plot, the civic body has given the society authorization to develop the land.

The sole judge had agreed with the majority’s position that, if the redevelopment proposal is approved, everyone will receive a larger home within three years without having to pay anything out of pocket. Since there are so few dissenting votes, section 41A’s condition for redevelopment is satisfied.

The single judge rejected the minority group’s protest and also ordered them to leave their apartments so that the structures might be demolished.

RAIPUR: In a first of its kind, the Chhattisgarh Real Estate Regulatory Authority (RERA) has issued an order transferring the Nardaha-based private housing project – City of Valencia – to the Chhattisgarh Housing Board in the best interests of the project’s plot holders.

The RERA took this action after basic facilities such as a road, electricity, water, and sewerage were promised by the project’s promoter, Aftab Siddiqui, in the brochure but were not built even after five years.

The promoter had brought a housing project of 1072 plots in Nardaha and promised all basic amenities, but even after five years, no development work had been done in the project.

Following the plot holders’ complaint, RERA decided to hand over the project to the Chhattisgarh Housing Board, which will now take possession of the project and provide RERA with an action plan for the development of necessary basic facilities within two months.

According to RERA president Vivek Dhand, 130 project plot holders filed a complaint with the RERA in 2019 alleging non-completion of development work.

During the hearing of these complaints, it was revealed that the promoter of this project had obtained development authorization in 2010 to build a well-equipped residential colony with a total of 1072 plots in this project, and a brochure of the same had been released.

A total of 691 plots in the project were sold, resulting in a profit of Rs 41 crore. This project was supposed to be finished by 2015, but even after 6 years, no development work had been done. According to the rules, the promoter did not even register the project under RERA.

According to the RERA president, the project was handed over to the Chhattisgarh housing board in accordance with a Supreme Court order. The Housing Board will also record this project in RERA in accordance with the rules. The Raipur district collector has been directed to take the necessary steps to transfer this project.

After the project is transferred, the Chhattisgarh Housing Board will have the right to develop it and sell the mortgaged and unsold plots. The Chhattisgarh Housing Board will also have the authority to execute the registered sale deeds and collect the sale proceeds.

After finalizing the development construction of the project in the prescribed time period and according to the estimate and work plan, the Chhattisgarh Housing Board will transfer the project to the housing society for the purpose of maintenance.

BENGALURU: The National Consumer Disputes Redressal Commission (NCDRC) has ordered city-based ND Developers to refund home buyers’ money plus 9% interest for failing to deliver the flats on time.

On March 31, 2011, more than 50 homebuyers decided to book flats at ND Laurel, a housing project at Gunjur, near Varthur in Bengaluru East, according to a complaint filed with the NCDRC against ND Developers Pvt Ltd and five others.

According to the agreement, ND Developers Pvt Ltd was required to provide legal possession of the flats with all did promised amenities and facilities to the home buyers by December 2012, with a four-month grace period, i.e. by March 2013. However, even after the deadline, the company failed to deliver the flats to the home buyers.

According to reports, the builder failed to obtain the occupancy certificate (OC) for the unfinished flats handed over to some of the buyers. According to reports, 24 of the 55 homebuyers received incomplete flats but did not receive occupancy certificates from the builder.

The NCDRC, chaired by presiding member Binoy Kumar and member Sudip Ahluwalia, has directed the opposing parties (ND Developers and land owners) to refund the entire amount deposited by the complainants, as well as delay compensation at 9% per annum on the deposited amount from the respective dates of deposits until realization, within two months.

“Any delay of more than two months will result in a 12% annual interest rate for the same period,” the NCDRC stated.

It has also directed the builder to complete the construction of the flats allotted to the complainants (24 home buyers) in all respects, obtaining the necessary OC at its own cost and responsibility, and offering possession of the flats to the complainants within six months along with delay compensation at 8% per annum from the proposed date of possession as per the respective agreements, which will include the grace period, until the offer of possession or obtaining OC.

“Any delay beyond two months will attract an interest rate of 12% per annum for the same period.โ€Any pending applications have been disposed of,” the NCDRC stated.

Home buyers have applauded the NCDRC decision and expect the builder to finish all outstanding work for those who have already taken possession of the flats. “I am very pleased with the NCDRC decision. I’ve been waiting for ten years to take possession of the flat. It’s a good decision,” said Santosh Krishnamurthy, one of the home buyers who complained to the NCDRC.
