NEW DELHI: On Tuesday, three individuals settled with the capital markets regulator, the Securities and Exchange Board of India (SEBI), concerning allegations of insider trading violations related to the scrip of PNB Housing Finance Ltd. The settlement was reached after a collective payment of Rs 1.56 crore.

The individuals involved in the settlement are Sidhant Chandalia, Naysar Parikh, and Ronak Narendra Parikh, as outlined in two separate orders issued by SEBI.

According to the settlement details, Sidhant Chandalia and Naysar Parikh each paid Rs 50.7 lakh as their portion of the settlement amount. Meanwhile, Ronak Narendra Parikh contributed Rs 45.5 lakh as a settlement charge and an additional Rs 8.98 lakh for the disgorgement of wrongful gains, including interest.

SEBI stated, “Given the acceptance of the settlement terms and the receipt of the settlement amount, the instant adjudication proceedings initiated against the Noticee(s) vide SCN (Show Cause Notice) are disposed of.”

The directives were issued following the submission of applications by the three individuals to SEBI, proposing to settle the ongoing proceedings against them “without admitting or denying the findings of facts” through settlement orders.

SEBI had initially launched adjudication proceedings against these individuals for their alleged violations of the Prohibition of Insider Trading (PIT) rules in connection with trading activities related to the scrip of PNB Housing Finance.

A show cause notice was issued to Sidhant Chandalia for allegedly communicating Unpublished Price Sensitive Information (UPSI) related to PNB Housing Finance.

Additionally, show cause notices were served to Naysar Parikh and Ronak Narendra Parikh, requiring them to explain why an inquiry should not be held and penalties imposed.

The notices were issued based on allegations that Naysar Parikh communicated UPSI while possessing it, and Ronak Narendra Parikh traded in the company’s scrip using the UPSI.

NEW DELHI: The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has escalated 250 cases concerning the possession of properties to the courts of adjudicating officers stationed at the Lucknow headquarters and the Gautam Budh Nagar office.

Of these, approximately 130 cases have been directed to the adjudicating officer at the Lucknow office, while about 120 cases have been assigned to the Gautam Budh Nagar office.

This action follows a review conducted by Sanjay Bhoosreddy, Chairman of UP-RERA, who assessed the compliance status of orders issued in response to complaints from property allottees.

The review revealed that many promoters were deliberately delaying the delivery of possession to allottees, even though there were explicit orders for them to do so within a specified period.

In response to these delays, UP-RERA has empowered the adjudicating officers to ensure that registered sale deeds and the delivery of possession are carried out following the provisions of Rule 24 of the UP-RERA Rules, 2018.

Under this rule, adjudicating officers hold the authority of the Code of Civil Procedure (C.P.C.), which they will utilize to accelerate the transfer of possession and the execution of sale deeds. Furthermore, these officers can attach properties and appoint receivers to enforce compliance with the orders.

To increase the pace of action, Chairman Bhoosreddy has now established a system whereby any case in which a promoter fails to provide possession as ordered by RERA will be automatically referred to the court of the adjudicating officers by the secretary, with the chairman’s approval. This process aims to ensure that all such cases are promptly addressed without unnecessary delays.

Bhoosreddy strongly disapproved of promoters who fail to deliver possession to allottees despite clear orders from RERA. He emphasized his commitment to regularly monitoring the status of these cases and implementing all necessary measures to protect the interests of the allottees.

He further stated that UP-RERA would take stringent actions against non-compliant promoters to uphold the authority’s decisions.

The adjudicating officers are now responsible for conducting effective and timely proceedings to ensure that sale deeds are executed and possession is delivered without further delay. These officers will play a critical role in upholding the allottees’ rights by ensuring promoters adhere to their commitments.

Moreover, UP-RERA has resolved that in every case referred to the adjudicating officers for ensuring possession delivery, it will impose substantial penalties on defaulting promoters.

UP-RERA will also work in coordination with the district magistrate to ensure the recovery of penalty amounts from the promoters who fail to comply with the orders. This measure aims to deter any future delays and reinforce the importance of adhering to RERA’s directives.

BENGALURU: Bruhat Bengaluru Mahanagara Palike (BBMP) is having a lot of trouble getting property taxes from some of the most prominent establishments in the city, including hotels, malls, developers, educational institutions, and charity trusts.

Approximately 3.63 lakh homes owed Rs 711.1 crore in taxes as of May 18. With 57,043 houses owing Rs 95 crore, Bommanahalli tops the list, followed by Rajarajeshwari Nagar with 55,073 properties owing Rs 54.31 crore.

Additionally, a difference of Rs 231.77 crore is expected to be paid by 1,66,557 properties.
“We are calling these defaulters and revising cases using an IVR system and sending them SMS messages every day.

They do not, however, make the overdue tax payments. Munish Moudgil, special commissioner of the BBMP (revenue), told TOI, “We will shortly begin special enforcement for recovery in accordance with the law.

Even though BBMP has previously made this list available to the public, many of the defaulters on it still do not pay their taxes. A significant source of funding for the BBMP is property tax, and the collection department faces ongoing difficulties because some properties have tax arrears dating back many years.

Numerous defaulters on the BBMP’s list have routinely disregarded numerous warnings over an extended period of time. Many property owners continue to be oblivious to their tax duties in spite of the BBMP officials’ attempts to ensure compliance, which include sending notices, sealing properties, taking possession of inheritances and immovable property, and even seizing bank accounts.

The bureaucratic procedure associated with these enforcement operations can be laborious and slow, which makes it more difficult for the BBMP to collect arrears.

“The defaulters bring a stay from the courts whenever we issue them notifications, which forces us to tie our hands. “What is the purpose of having a revenue cell if the stays prevent it from operating at its best?” Moudgil said.

In the hopes that many would pay up, we have so developed the OTS, a time settlement plan,” he continued.
A 5% discount is available under the scheme for payments made over a longer period of time.

Even with this incentive, many property owners are still averse to paying their debts, which is dishearteningly low compliance, according to Moudgil.

Property owners who have not paid their taxes on time have received several notifications. Form 13 has been sent out in response to those who disregard these letters, starting the process of entering BBMP’s claim into the Deputy Registrar’s office records.

The goal of this legal action is to impose a lien on the property, making it more difficult for owners to transfer or sell it without paying the overdue taxes.

“To improve accountability and transparency, we have made the list of the top defaulters available to the public. The BBMP intends to put pressure on the defaulters to make amends by identifying and publicly humiliating them. However, this strategy hasn’t always worked well, so it’s unclear if it will work better this time around, Moudgil continued.

MUMBAI: Real estate developers are expected to submit an annual self-declaration of the quality assurance of their projects to the Maharashtra Real Estate Regulatory Authority (MahaRERA). This self-declaration will be based on a number of factors, including structural design, stability, testing, input material quality, workmanship quality, and other important considerations.

The action is intended to guarantee that standards are defined for procedures, materials, and to reduce the likelihood of errors and difficulties for purchasers.

It is suggested that compliance with the new rules will be voluntary in the beginning. Developers who voluntarily accept the method will have their names listed on the MahaRERA website, which will help to enhance their reputation with prospective purchasers. Following suit will become necessary for all developers after the transition phase ends.

Defect liability is covered by the Real Estate (Regulation and Development) Act, 2016. The law protects the interests of flat buyers by holding developers responsible for fixing any structural flaws that are discovered within the first five years of occupancy. Within 30 days, the developer is expected to fix these bugs at their own cost.

A draft regulation for the project’s quality assurance has been floated by the regulator. The developer will be required to submit a self-certification declaration for the project that includes comprehensive details on its technical features. Up to May 23, comments on the same are welcome.

MahaRERA published a discussion paper in December outlining steps to improve the quality of homes and anticipate complaints from buyers over construction flaws or inadequate construction quality.

Such a rule was required due to ongoing discussions and worries about the quality of construction provided by the real estate industry. MahaRERA has already conferred with several real estate players in order to compile the draft, therefore it is anticipated that this action will allay worries regarding the caliber of construction in the real estate industry.

MahaRERA states that although the law offers corrective options for fixing problems, it is crucial to protect the interests of homebuyers, necessitating the establishment of procedures and guidelines to reduce the likelihood of defects.

According to the self-declaration, there are a few crucial issues that must be resolved right away. Some of these are to soil testing prior to the design process, hiring structural engineers, periodic certification for quality control, etc. in terms of structural design and stability.

It will also include elements like a facility for on-site testing to check the quality of raw materials and routine site inspections to guarantee the quality of building supplies like steel, concrete, cement, electrical cables, plumbing fixtures, etc.

In addition, the project manager and engineers must document and certify information about earthquake-resistant construction, fire safety, and other related topics after the project is finished. Before submitting the “Self-Declaration on Quality Assurance” to MahaRERA, the project promoter will also need to revalidate these.

LUDHIANA: Ludhiana Improvement Trust (LIT) has been ordered by the district consumer disputes redressal commission to compensate a complaint Rs 1 lakh for not granting the complainant possession of an apartment even after 14 years.

The commission has directed the LIT to reimburse Hem Raj Kapila of Gill Road for the compensation within 30 days of receiving a copy of the judgment; if they don’t, they risk being further penalized by having to pay interest on the amount due, which will accrue at the rate of 8% annually from the date of the order until it is actually paid.

According to the complainant, on February 26, 2005, he submitted an application and paid Rs 1, 50,000 for the allotment of HIG 108 and HIG Super 54 multi-story semi-finished flats to be built in Rajeev Enclave, Shaheed Bhagat Singh Nagar, under the Self-Financing Scheme.

The opposing parties allocated HIG an apartment under the development project on April 29, 2005, the day of the flat allocation draw. He was required to pay the whole cost of the apartment in instalments totalling Rs 14,60,000 in accordance with the payment plan.

In relation to the apartment allotment, the opposing parties executed an agreement of sale dated June 21, 2006 in his favor. He paid Rs 2, 74,150 via demand draft dated October 4, 2005, which was returned due to the delay.

The postponement was then excused on May 2, 2006. The complainant went on to say that he paid the Rs. 2, 19,000 instalment dated September 7, 2006. He allegedly went back to deposit the draft and a banker’s check for Rs. 2, 19,000 dated March 7, 2007, but the opposing party’s official would not accept it.

After receiving a letter from the complainant, the opposing parties informed the complainant in writing on April 26, 2007, about a civil court stay on the apartments, which prevented construction from beginning.

On December 11, 2006, the executive engineer issued an order deferring the receipt of installments until additional orders were received. They also stated that they would provide a new installment schedule for deposit after obtaining the stay dismissed.

The complaint claims that he often went to the opposing parties’ office to request the issuing of a new installment plan and the possession of the apartment that was given to him, but he was never successful.

The plaintiff added that just 21 of the 162 flats that were supposed to be built under this scheme—including his own—had their construction suspended by opposing parties as a result of court orders. Of the 141 flats that remain, 95 have been turned over to their respective allottees, leaving only 46 empty.

The complaint attempted to turn over control of the apartment to the opposing parties, as did a few other allottees who were suffering as a result of the OPs’ negligence, carelessness, and lack of service, but to no avail.

The plaintiff was, nevertheless, prepared to pay the remaining amount in installments, provided that a new schedule was issued and the apartment was delivered. The complainant served them with a legal notice dated June 12, 2020, but they did not respond.

Therefore, the complaint has requested that the opposing parties give him vacant possession of the apartment after accepting rescheduled payments for the remaining installments or grant the complainant an apartment in their other scheme under the same terms and conditions. It has also requested compensation in the amount of Rs. 2, 00,000 and reimbursement for Rs. 55,000 for legal fees.

KOLKATA: On Thursday, the Registrar of Assurances was instructed by the Calcutta High Court to refrain from registering any property sale deed without the approved plan.

Chief Justice T S Sivagnanam and Hiranmay Bhattacharyya, sitting as a division bench, issued the ruling while noting that the structure, which was still under construction when it collapsed in the Garden Reach neighborhood, lacked a sanction plan.

“It has been constructed over a body of water that has existed for the past forty years. The chief justice stated, taking note of the report submitted by the Kolkata Municipal Corporation, “that the land conversion was authorized by the land revenue officer and the block land.”

The panel ordered the state government to provide the relatives of the deceased an additional Rs 3 lakh in compensation, on top of the Rs 2 lakh ex gratia that each family had already received. In addition, the division bench ordered the state to give each injured person an additional Rs 1 lakh in addition to the Rs 50,000 they had already paid.

In the Garden Reach case, the division bench further ordered the petitioner to send notice to Shams Iqbal, the local council member, and the developer, who is currently incarcerated at the Presidency Correctional Home. The chief justice declined to accept that comparable unpermitted constructions were occurring in the city without the consent of MLAs or local council members.

“What was the elected official doing throughout the construction? The CJ noted that they were unfit to remain in their position. Attorney Jaydeep Kar for KMC argued that the accused cops had been suspended by the civic body at the court’s request.

The court voiced its “anguish” about the absence of “official and political will” on the part of the authorities to carry out the court orders on unauthorized structures to their logical conclusion, even as it noted the KMC’s move to welcome complaints about unauthorized projects from the residents.

“Without official and political will, the enforcing agency cannot take action. There has been no activity at Bidhannagar. After visiting the location, the Bidhannagar Police Commissionerate leaves, citing protests from the general population.

Yesterday, something similar occurred in another area of the city, according to the CJ. “Free reign should be granted to executive engineers.” Please let your cops do their jobs. You support them,” he remarked.

The CJ took use of the occasion to highlight the KMC’s inability to control hawkers operating in front of the organization’s offices.

Because the West Bengal Victim Compensation Scheme was revised in 2017 and simply sets the lowest limit of compensation rather than capping the maximum limit, the court sided with the state and enhanced the payout.

To expedite the resolution of cases, the Uttar Pradesh Real Estate Regulatory Authority (UP RERA) began a pre-hearing review of complaints on Monday.

Homebuyers and promoters can file complaints through the e-courts facility provided by UP RERA. On December 2, 2023, it released updated standard operating procedures (SOP) for the submission, review, and hearing of complaints as well as for conciliation.

In doing so, UP RERA, according to a statement, not only made the complaint submission process more straightforward but also more thorough. “The procedure is now easier to use and will support early listing and prompt resolution of complaints. The regulatory body stated that this service can be accessed on the UP RERA portal starting on Monday, January 15, 2024.

The legal division of UP RERA will carefully review the new complaint and its attachments, according to the process explanation, to ensure that the project’s details, those of the respondent or promoter, and the complainants are accurate and consistent with the information entered in the allotment letter or builder-buyer agreement (BBA).

Additionally, it will verify whether the customer has turned in self-attested, readable copies of all pertinent paperwork, including the BBA, the booking application, the allocation letter, the payment receipts, the bank statements, and the promoter’s account ledger.

The customer must deposit copies of the bank’s loan sanction letter that have been self-attested. According to the statement, RERA will make sure that the details of the money’s deposit match the supporting documentation.

“The RERA office will review the complaint and let the complainant know about any objections within seven days; they must be addressed within fifteen days. After fifteen days, the complaint will receive a reminder to correct any outstanding concerns within a further seven days, according to UP RERA.

“After the rectification of the challenges, the legal division of RERA will mark the claim file as ‘Fit-For Hearing’ and submit the same to the appropriate Bench for hearing,” it stated.

The legal office will transmit the complaint file for a hearing before the Bench with the specifics of the outstanding defects if the complainant fails to correct the effects even after being reminded. It further stated that in such a scenario, the complainant would lose out on the opportunity for prompt resolution of his complaint.

The new system for reviewing complaints will be very beneficial to customers, who can now file grievances with RERA even without the assistance of experts, according to UP RERA Chairman Sanjay Bhoosreddy.

He stated that the complainant would not have to waste time and effort repeatedly for the correction of defects and submission of documents at a later time once the complaints are recorded with all pertinent documents and after the defects have been fixed.

“The move is intended to also help the Benches in quick resolution of cases and imparting speedy justice to the customers,” Bhoosreddy stated.

The chairman of UP RERA urged all stakeholders and customers to use the revised SOP found on the organization’s website while submitting their complaints and any supporting documentation.
